Use of AI Disclaimer
Last updated: Effective as of the date posted in our documentation. ExChek, Inc. (“ExChek,” “we,” “us”) is a Delaware corporation with a principal place of business in Dover, DE.
This Use of AI Disclaimer (“Disclaimer”) applies to all use of the ExChek skill, API, and related services that involve artificial intelligence (“AI”), regardless of which AI assistant, chatbot, or agent platform you use—including but not limited to Anthropic Claude (Claude Code, Claude desktop, Claude web, Claude CoWork), OpenAI ChatGPT, or any other third-party AI or agent. By using the ExChek Service in connection with any such AI or agent, you acknowledge and agree to this Disclaimer.
1. Scope: Use Through Any Agent or Platform
The ExChek skill and documentation may be used with multiple AI and agent environments. For example, you may run the ExChek skill inside Claude (e.g., Claude Code or Claude desktop), ask ChatGPT to follow ExChek documentation or use the ExChek API, or use another AI or agent that has access to our prompts, templates, or API. This Disclaimer applies to all such use. ExChek does not control the behavior, output, or terms of any third-party AI or platform. Outputs may differ depending on which agent or platform you use. You are responsible for your choice of platform and for verifying any result before relying on it.
2. What ExChek Provides
ExChek provides (a) a skill—instructions, prompts, and a report template that guide an AI or agent to collect item information, retrieve regulatory data (e.g., 15 CFR Part 774, 22 CFR Part 121), apply order-of-review logic, and produce a draft classification memorandum; (b) an API that serves regulatory snapshot data (e.g., GET /api/ecfr/774, GET /api/ecfr/121) for use by an AI or agent; and (c) documentation. The skill is designed to be used with human oversight: you confirm jurisdiction and approve the final classification before the report is generated. ExChek does not operate, host, or control the AI models or platforms (such as Claude or ChatGPT) that execute these instructions.
3. AI-Generated Outputs Are Assistive Only
All outputs produced by or with the assistance of the ExChek skill or API—including classifications, rationales, citations, and report text—are assistive only. They are not legal advice, compliance advice, or regulatory determinations. They do not replace (a) human judgment, (b) formal agency processes (such as a classification request to the Bureau of Industry and Security (BIS) or a commodity jurisdiction request to the Directorate of Defense Trade Controls (DDTC)), or (c) advice from qualified counsel or a qualified export compliance professional. The accuracy and completeness of AI-generated content can vary by model, platform, and context. You must independently verify any classification or report before using it for compliance, licensing, disclosure, or any other purpose.
4. No Warranty as to Accuracy or Suitability
ExChek does not warrant that any AI-generated output is accurate, complete, current, or suitable for your situation. Regulatory interpretations, order-of-review application, and classification outcomes can vary. Third-party AI platforms (e.g., Claude, ChatGPT) may produce different outputs from the same inputs and may make errors. You are solely responsible for verifying any output and for ensuring that your use of the Service and any output complies with applicable law and your internal policies. You assume all risk of use.
5. Human Oversight and Final Responsibility
The ExChek skill is intended to be used with explicit human oversight. You (or your designated personnel) should confirm jurisdiction (e.g., BIS vs. ITAR) and approve the final ECCN or classification before relying on or distributing any report. You assume full responsibility for those decisions and for any use you make of the resulting memorandum or data. ExChek is not responsible for decisions made by you or your agents based on AI-generated outputs.
6. Third-Party AI and Platform Terms
When you use the ExChek skill or API through an AI or agent (e.g., Claude, ChatGPT, or another platform), your use is also subject to the terms, policies, and privacy practices of that platform. ExChek is not responsible for the availability, performance, or conduct of any third-party AI or platform. Data you provide to an AI or platform may be processed according to that provider’s policies. You are responsible for understanding and complying with those terms.
7. Regulatory Context
U.S. export control classification is governed by the Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR), and related agency guidance. The ExChek Service is intended to assist with understanding and applying order-of-review and regulatory structure; it is not a substitute for a formal BIS classification request, DDTC commodity jurisdiction determination, or advice from qualified professionals. For legally binding or high-stakes determinations, you should follow applicable agency procedures and seek appropriate professional advice.
8. Limitation of Liability
To the maximum extent permitted by applicable law, ExChek, Inc. and its officers, directors, employees, agents, and affiliates disclaim all liability for any loss, damage, cost, or claim (including indirect, incidental, special, consequential, or punitive damages) arising from or related to (a) your use of the ExChek Service in connection with any AI or agent, (b) any output generated by or with the assistance of the Service, (c) your reliance on any such output, or (d) the acts or omissions of any third-party AI or platform. Use of the product is at your own risk. Our total liability is subject to the cap and limitations set forth in the Terms and Conditions.
